Introduction and acceptance

These Terms of Service ("Terms") are a legal agreement between you and PMakers Games for use of the mobile app Folio Detective (Android package com.pmakers.games.folio.detective), the associated institutional website, and related services.

By accessing or using our services, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the app or website.

Eligibility

Folio Detective is not directed at children under 13. By using our services, you represent that you are at least 13 years old.

If you are between 13 and 18 (or the age of majority in your jurisdiction), you represent that you have permission from a legal guardian to accept these Terms.

License to use

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use Folio Detective on devices you own or control, solely for personal, non-commercial purposes.

You may not copy, modify, distribute, sell, rent, sublicense, reverse engineer, decompile, or attempt to extract the source code of the app, except where expressly permitted by law.

Accounts and authentication

Some features require creating an account or signing in (for example, email or Google login). You are responsible for keeping your credentials confidential and for all activity under your account.

You agree to provide accurate, up-to-date information and to notify us promptly of any unauthorized use of your account.

We may suspend or terminate accounts that violate these Terms or pose a risk to the platform or other users.

Advertising

Folio Detective is free to play and may display third-party ads to sustain the service. We use interstitial ads, which may appear at natural gameplay breaks (for example, when closing a conversation or changing scenes).

Whether ads are shown may depend on factors such as in-game progress, account configuration (including early periods with fewer ads or ad removal, when available), and advertising network policies.

Ads are provided by third-party networks (for example, Google AdMob) and are subject to those providers' terms and policies. We may change ad frequency, format, or availability at our discretion.

When available, removing ads via an app-store purchase (for example, Google Play) is subject to that store's policies and applicable law. Refunds follow the store's rules.

Usage limits, quotas, and anti-abuse protection

Folio Detective uses artificial intelligence in parts of gameplay (for example, character conversations). To protect the service against bots, spam, automated abuse, and excessive use that harms availability or platform costs, we apply usage limits (quotas) — such as daily, weekly, and/or monthly caps — and other technical protection measures.

These quotas are an anti-bot and anti-spam system: they are not a permanent ban, have no monetary value, and are not a separate product. When you reach a limit, affected online features (such as character chat) may be temporarily unavailable until the relevant quota window resets.

We may adjust limits, windows, and protection rules at any time as needed for safe and sustainable operation of the service. Attempting to circumvent quotas, rate limits, or other protections (including through multiple accounts, automation, or identity spoofing) violates these Terms and may result in suspension or termination of your account.

Acceptable use

You agree to use our services only for lawful purposes and in accordance with these Terms. You must not:

• Use the app for illegal, fraudulent purposes or in ways that infringe third-party rights.
• Attempt to access, interfere with, or compromise our systems, servers, or networks.
• Use bots, scripts, automation, or reverse engineering to gain an unfair advantage in the game.
• Circumvent, bypass, or attempt to evade usage quotas, rate limits, or other anti-abuse measures.
• Harass, threaten, or send offensive, discriminatory, or illegal content through the services.
• Infringe PMakers Games' or third parties' intellectual property rights.
• Resell, sublicense, or commercially exploit the app or its content without authorization.

AI-generated content and fictional characters

Folio Detective uses artificial intelligence to generate dialogue and responses from fictional characters inspired by classic works. This content is produced automatically and may contain inaccuracies, inconsistencies, or unexpected results.

Characters and narratives are fictional and do not constitute professional, legal, medical, or other advice. Do not rely on in-game information for real-life decisions.

You are responsible for content you send to in-game characters and for how you use those interactions.

Intellectual property

Folio Detective, including but not limited to software, art, audio, text, trademarks, logos, and design, is owned by PMakers Games or its licensors and is protected by intellectual property laws.

Nothing in these Terms transfers ownership of the app or its content to you, except the limited license described above.

Third-party services

Our services may integrate with or depend on third-party providers (for example, authentication, cloud infrastructure, AI processing, advertising networks, and app stores). Use of those services may be subject to their terms and policies.

We are not responsible for third-party products, services, or content accessed through the app or website.

Disclaimer of warranties

Folio Detective and related services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or secure, or that defects will be corrected.

Limitation of liability

To the maximum extent permitted by applicable law, PMakers Games and its directors, employees, and partners shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or reputation, arising from use or inability to use the services.

Our total liability for any claim related to the services shall not exceed the amount you paid to PMakers Games in the twelve months before the event giving rise to the claim, or BRL 100.00, whichever is greater, unless applicable law requires a different limit.

Termination and account deletion

We may suspend or terminate your access to the services at any time, with or without notice, if you violate these Terms or for other legitimate reasons.

You may request deletion of your account and associated data as described in our Privacy Policy and on the dedicated account deletion page.

Changes to these Terms

We may update these Terms from time to time. The date of the last revision will be shown at the top of this page.

Material changes may be communicated through the app, website, or other appropriate channels. Continued use of the services after changes are published constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by the laws of the Federative Republic of Brazil, without regard to conflict-of-law provisions.

Any dispute arising from these Terms shall be submitted to the courts of the consumer's domicile, where applicable, or to the courts of São Paulo, Brazil, unless mandatory law provides otherwise.
